Cold Email

Also known as: cold outreach email, cold emailing

Cold email is sending a business email to a prospect you have no prior relationship with, to start a conversation. Unlike spam, effective cold email is targeted, relevant, and personalized — sent to a specific person because they fit and have a problem you solve. In the U.S. it's legal under CAN-SPAM as long as the email is honest, includes a physical address, and offers a working unsubscribe.

Cold email vs. spam

The difference isn't whether the recipient asked for it — by definition they didn't — it's relevance and intent. Spam is generic, mass-blasted, and deceptive; good cold email is sent to a researched, well-fit prospect, references something true about their situation, and makes one small, honest ask. The job of a cold email is not to close a deal but to earn a reply that opens a conversation.

Is cold email legal?

B2B cold email is legal in the United States under the CAN-SPAM Act, provided each message uses a truthful subject line and sender details, includes a valid physical mailing address, and gives the recipient a working way to opt out. Other regions (such as the EU under GDPR) have stricter consent rules. The bigger practical risk than legality is deliverability: cold email that's done sloppily lands in spam and damages your sending reputation.
